Hexahydrocannabinol and Tetrahyrdocannabinol – two psychoactive compounds found in cannabis that are incredibly similar as far as chemical structure and effects; but also, quite different in many ways, such as how it metabolizes in the body, and legality. Let’s further explore the differences between HHC vs THC. What is HHC?Hexahydrocannabinols are another group of psychoactive cannabinoids that are very similar to tetrahydrocannabinols. HHC is basically a simplified version of Delta 9 THC. Both HHC and Delta-9 THC have very similar molecular structures but with HHC, all the double bonds have been broken and replaced with hydrogen (AKA hydrogenation). It was discovered during research in the 1960s and 70s in which the goal was to find the most basic cannabinoid-like substances that could still bind to CB receptors. There is a biologically active naturally occurring (−)-hexahydrocannabinol, as well as its synthetic enantiomer (+)-hexahydrocannabinol. The natural HHC is known scientifically as 6aR,9R,10aR-Hexahydrocannabinol, and it’s a trace compound that can be extracted from cannabis pollen. The synthetic variety which goes by the chemical formula 9-Nor-9β-hydroxyhexahydrocannabinol, can be found in spice. First, synthetic cannabinoids can be compounds that do not exist in nature and must be created in a lab, like THC-O. A synthetic can also be a cannabinoid that does exist in nature, but in such low amounts that it wouldn’t really make sense to extract it, as you would need a ridiculous amount of plant matter to do so. In such cases, it must be synthesized in a lab. This is very common with Delta 8 THC products. We’re seeing a small influx of new, HHC-P products, hitting the store shelves, but it’s close to impossible to find any information about this cannabinoid that comes from a neutral, fact-based party rather than from the companies who are selling it. It’s likely because, the companies selling the compounds are also the ones who are creating them in the first place, and no one else really knows about these compounds or has had the opportunity to study them yet. What is THC?THC, or tetrahydrocannabinol, is the primary psychoactive compound in cannabis responsible for the “high” we all know and love. THC is secreted by the resin glands, or trichomes. There are three types of trichomes: bulbous, capitate-stalked, and capitate-sessile, and they are found all over the flowers. THC acts similarly to the cannabinoid-type chemicals made naturally by the human body (endocannabinoids), which is why it can be useful in the treatment of so many different conditions. Cannabinoid receptors 1 and 2 (CB1 and CB2) can be found throughout body and they make up part of the larger endocannabinoid system. Collectively, these receptors and the compounds that interact with them contribute to many of our most important physical and psychological functions including learning and memory, emotional processing, sleep, temperature control, pain control, inflammatory and immune responses, and eating. Because THC attaches to these receptors directly, whereas CBD interacts with other receptors that then engage the ECS, it’s believed that THC might be the most beneficial compound in the cannabis plant. There are many different types of THC including natural ones such as delta 8 and 9, synthetic ones like Delta 10 and THC-O, and trace ones that include THC-P, THC-H, and THC-B. We also have THCA, which exists in the raw plant and is a precursor to all other tetrahydrocannabinols. And there is also hydroxy-11 THC, a metabolite formed by our bodies during the digestion of tetrahydrocannabinols (when we use edibles). Drug Testing: HHC vs THCTHC, in all of its forms, does show up on drug tests. That’s because, contrary to popular belief, standard urine tests don’t screen for the THC (tetrahydrocannabinol) in cannabis, but rather, they detect the metabolites created by the human body when we are exposed to THC. This class of metabolites is known as THC-COOH. These metabolites are nonactive, so drug tests are only measuring exposure, NOT impairment. Marijuana impairment cannot be detected through any kind of test thus far. ![]() THC-COOH, or “carboxy THC” is the most common name for this metabolite. It’s the second THC-metabolite formed in our bodies, following hydroxy-THC, immediately after exposure. THC-COOH is lipid-soluble, meaning it’s stored in our fat cells making it detectable in our systems for much longer than other substances, those that are water soluble for example. So, what about HHC? Short answer, it’s hard to say. Anecdotal evidence as well as numerous first-hand accounts I found online claim that it does NOT trigger a positive. However, I have not tested this myself, nor have I been able to find any official research or documentation on the matter. That being said, there is also a strong possibility that even if HHC doesn’t make you pop on a test, your product could contain traces of other compounds that will, such as Delta 8 or Delta 9 THC. If you have anything important riding on your drug test, it’s best to abstain from all cannabis products to be on the safe side. LegalityWhen it comes to the legality of both THC and HHC, it’s a little bit complicated. Delta 9 THC is largely illegal, federally and in most states. This is because it’s the most abundant psychoactive compound in marijuana, which is the legal classification for cannabis varieties containing more than 0.3% THC. However, when delta 9 THC is derived from hemp, it is considered legal, or at the very least, it falls into a legal grey area where many products containing it manage to slip under the radar. This applies to HHC as well. Because it’s extracted from hemp or cannabis pollen, it falls under that legal loophole created by the 2018 Farm Bill. HHC is also one of the few compounds that is completely unregulated in Europe, and it seems to be an emerging market in certain countries, such as Spain and Germany. A Few More Notes on HHC vs THCOne of the most common questions when it comes to HHC vs THC, is which one is stronger? Well, that’s not always a straightforward answer when it comes to cannabis compounds. Let’s start with the fact that everyone’s bodies are different, so the way cannabinoids affect them can vary greatly. HHC is still a lesser-known compound, so probably the majority of cannabis users prefer THC products. Although interest in vaping technology has really blossomed lately, the idea behind it is much older than most people realize. One of first patents for an electronic device to vaporize plant compounds was filed in 1927 by Joseph Robinson. The device was never commercialized, as a matter of fact, no one knows if Robinson ever manufactured a prototype. But the idea was there. Many more vape designs emerged throughout the 20th century. A few of the more popular ones include the “Shake and Vape”, a bulbous glass pipe meant for vaping weed that was invented by Cherokee medicine man Eagle Bill, and the infamous Volcano Vaporize released in 2000 by Storz and Bickel, which became really popular among millennial stoners. Everyone at least knew someone with a volcano back in the day, and the still remain one of the iconic vape devices on the market. A few years later, in 2002, Chinese entrepreneur Hon Lik invented the e-cigarette. Met with much skepticism in the beginning, it’s now a stable item in U.S. smoke shops, head shops, and dispensaries. Conduction vs ConvectionAbove I mentioned convection and conduction, which are two possible heating methods used in vapes. It’s relatively simple, but I wanted to go over each process in a bit more detail. In convection heating, the substance makes direct contact with the heat source. Think of it like boiling water – you apply heat to the pot which then boils the water from the bottom up. Is Vaping Actually Safer Than Smoking?Vaping is touted as the safer alternative to smoking, but how safe is it really? Naturally, a great deal of anecdotal evidence suggests that it is considerably easier on the lungs. There is certainly a lack of controlled, randomized testing comparing the effects of smoking weed products versus vaping them (or vaping versus smoking in general); but there can be many reasons for that, ranging from the fact that cannabis is still federally illegal, to the knowledge we have about big tobacco and how much money they give to the government through lobbying and political donations. That said, despite vaping likely being safer than smoking, it’s not without risks of its own. Let’s face it, ideally, you should not be inhaling anything into your lungs aside from oxygen. But we do, so our goal is to do it as safely as possible. Some studies, like this one from the University of Michigan, actually argue that vaping is even more dangerous than smoking, but it’s hard to see how that could be true. Regardless, there are some things to consider when vaping that could possibly make it even less safe, such as the addition of vitamin E acetate or other fillers in unregulated vape products. Also, the way you take hits could make a difference as well. I’m a heavy weed smoker and I’ve noticed that sometimes when I hit my vape pens, I draw way harder than I should (as if I’m hitting a blunt or joint) which leads to way more coughing than I experience when smoking – but that’s more of a user-error type of situation. When it comes to tobacco, the majority of studies found that e-cigs are safer but not free of risk. “E-cigarettes heat nicotine (extracted from tobacco), flavorings and other chemicals to create an aerosol that you inhale. With racism and inequality still very much existing, despite the Civil Rights Act of 1964. A change in law does not directly cause a change in people. At Least not instantly. In a different sense, the ‘war on drugs’ has also failed. Nixon’s decision to demonize those using drugs, as well as the substances themselves, has not and never will stop production and use. The UN has recently berated this consensus, and called for an end to it, stating that the war on drugs… “Undermines health and social wellbeing and wastes public resources while failing to eradicate the demand for illegal drugs and the illegal drug market. Worse, this “war” has engendered narco-economies at the local, national and regional levels in several instances to the detriment of national development. Such policies have far-reaching negative implications for the widest range of human rights” Laws – for good or for worse – do not always directly influence the real world. In the world of drugs, this almost never happens, unless enforced by a dictatorship. Although, even then, Hitler was supposedly a cocaine abuser. Consider, for a second, the cannabis laws within the UK. Whilst the substance is illegal and classed as a type B drug (the second most extreme), there are still 1.4 million cannabis users within the UK. Two realities exist side by side. De jure vs de facto. Laws vs culture. This is what is also being confirmed to me as I travel through Nepal. Whilst many drugs are still illegal here, it doesn’t stop them being an important part of society. NepalNepal is a landlocked country that is situated between the two huge looming nations of China and India. With a population of 30 million, it is slightly bigger than the state of Arkansas or the European country of Portugal. In fact, it is the 25th smallest nation in Asia. Most of Nepal finds itself in the Himalayan mountain ranges, home to, of course, Mount Everest. This beautiful land of mountains, jungles and busy cities is where I will be residing for the next month of my travels. Nepal is believed to have existed back in the ancient times of the 30th Century BC. Whilst India experienced the pointless imperial rule of the UK, Nepal remained unscathed. Record Nepal writes: “There was little fear of British military intervention in Nepal from the moment the British acquired its newly conquered territories of Kumaon, Garhwal and parts of Sikkim after the Anglo-Gorkha war; the difficulties of a military expedition in the hills of Nepal were clear to the British.” ![]() It is nice, for a change, to visit a country where the United Kingdom hasn’t laid its filthy colonial hands. Nepal is a spiritual nation, with some incredible food and beautiful landscapes. But as I enjoy the fusion of Chinese-Indian food, thukpa and masala, I can’t help but wonder where drugs sit in the culture of this place. Drug Laws in NepalDuring my first day in Kathmandu, the Nepalese capital, I wandered the tourist streets of Thamel and was probably asked about 50 times whether I wanted to buy hashish or psychedelics. The hash I was expecting, but LSD and magic mushrooms l was not. However, I was also aware that this was a tourist area, and perhaps these dealers were just catering to their Western, drug-loving visitors. Let’s take a look at the drug laws in Nepal, maybe this will help us understand more. Anyone who is found purchasing, selling or consuming cannabis or hash in Nepal will be subject to a prison sentence and fine. The length and total fee will depend on the amount of this substance in question. For example, up to 50 grams can result in 3 months in prison, with a 3000 NRS fine. This is around 25 dollars. However, if you’re found with 10kg or over, this can result in a 2-10 year prison term, with a 100,000 NRS fine. This is around 800 dollars. It is interesting that, according to Nepalese law, whatever amount of cannabis or hash you are involved in, it will supposedly lead to a prison sentence. This seems slightly harsh and unlikely to me. As written in the Narcotics Drug Control Act of 1976, much is the same with any other recreational substance: “Anyone who consumes opium, coca or any other narcotic drugs made therefrom shall be punished with imprisonment for a term of up to one year or with a fine of up to Rs 10,000… Anyone who consumes any natural or synthetic narcotic drugs and psychotropic substances and their salt and other substances… shall be punished with imprisonment for a term up to two months and with a fine up to Rs 2,000 or both.” However, whilst the laws on drugs are strict and have been for some time, there is an inbuilt societal connection to certain substances which cannot be changed. Plus, the mountainous and diverse wildlife that Nepal has, makes it hard to limit the type of natural drugs that grow – such as cannabis or hash. Drug Culture in NepalHashish, or charas, has grown naturally in Nepal for centuries, some believe it grew in prehistoric times. In fact, it is sometimes considered that the feet of the Himalayas is where cannabis first derived. Could it be that Nepal grew the first ever joint? Nonetheless, the substance does grow there naturally in the wilderness and isn’t stopped by the government. Himalayan Trekkers writes that whilst it is illegal to cultivate, possess or consume cannabis… ![]() “It is said that the wild-grown hashish in the mountains of Nepal is the best among the hashish found in the world… Nepal was known to be heaven for Marijuana lovers in the late 60s and early 70s as marijuana, hashish… were legal before that period. The government of Nepal illegalized the use of Cannabis in 1973 AD because people started migrating to Nepal because of the legal production and trade of Marijuana. “ It is true, before the cannabis ban, Nepal was surely on the hippie trail hotspot list. Plus the substance is also a part of religious and spiritual celebrations. 80% of the Nepalese population follows Hinduism and the pujari and sadhus of this religion have an unofficial exemption from the cannabis ban. It is respected that they use cannabis to help their meditation, which is them imitating Shiva. During Maha Shivaratri – the great night of Shiva – sadhus come together, as well as many others, to smoke hashish in pipes. You can witness this occurrence in temples around Nepal, including Kathmandu. Final ThoughtsIn Kathmandu the smell of hash was commonly in the air, with holy men holding some questionable pipes. However, as I go further into the mountains and closer to the Himalayas, I expect this type of sight to increase. I’m still waiting to try some myself but I’m certain I will. With the religious connection It seems inevitable that Nepal will one day legalize cannabis, but perhaps also it’s not for the best. The post 2000s were and still are a great time for horror, full to the brim with nostalgia and psychological thrillers. All of these movies are guaranteed to make your holiday a thrilling one. Many people enjoy the heightened senses that weed brings, along with intensified colors, sounds, smells and thoughts. The cannabis plant can make almost every experience better. However, if you’re someone who is inclined to feelings of paranoia or panic, it can also make every experience worse. I’m going to assume that anyone reading this is at least partially intrigued by the idea of watching horror films stoned and, on the whole, has a decent relationship with the substance. Ultimately, watching scary movies whilst being high makes complete sense. A film director, Timothy Schultz, says: “I think a lot of cannabis users would agree that it can heighten senses. This can definitely change the way you experience a movie, especially from the horror genre. There are a lot of over-the-top moments in horror films. Whether it’s scary, funny or psychologically mind-blowing, those feelings can be intensified.” Unless you’ve been forced into watching a scary movie by your mate, then chances are that you’re doing it in order to feel the thrill of fear. In that case, getting stoned beforehand is an excellent idea. Every moment, every jump, every anti-climax, every grip of blood and gore – will be made that extra bit exciting. In fact, you may even find connections and have more deep thoughts than you would have done without weed. So why not give it a go this Halloween? Without further ado, here are my top 6 films of the post-2000s to watch stoned this holiday. Disclaimer: this is in no particular order. 1. The Ring (2002)It’s probably best to avoid focusing on rotten tomatoes and IMDB reviews when it comes to certain horror films. On the whole, they’re often reviewed pretty harshly. Nonetheless, the Ring finds itself on this list and deservedly so. This movie is one of the best horror films I ever watched and I couldn’t sleep for weeks. The image of the girl, with her black hair covering her face, walking on all fours, whispering “7 days” into the phone, was one I have never been able to shake off. The film is about a videotape that, when watched, will give you only 7 days to live. The Ring girl, also known as Samara, will find anyone who has watched the tape, come through their television, and kill them. The film follows Naomi Watts’ character as she tries desperately to discover more about the tape’s origins before her 7 days are up. This movie is excellently scary, with incredible visuals and, if that isn’t enough, a pretty decent cast. 2. Hereditary (2018)Hereditary is part of a new wave of horror films that began recently with decent budgets and an amazing cast. Essentially, it’s actually an incredible movie – 90% on rotten tomato and is graced by a wonderfully spooky performance by Toni Colette. The film is an absolute mind boggle and is horrifying from start to finish. After the death of her mother, Collete’s character soon begins discovering strange things about her mum’s past. This film, to some, is considered the scariest of all time. It’s the kind of film you’ll never forget watching, especially the moment with the severed head – I’ll say no more than that. Just watch it. 3. It Follows (2014)![]() It Follows is one for those who respect indie films with smaller budgets. But don’t be swayed by its lesser known cast and smaller finances, this film has 95% on rotten tomatoes and an array of awards. What makes It Follows so incredible is in its simplicity. In essence, there is a sort-of STI going round that can be passed from person to person. The only way to get rid of it, is to have sex with someone else and pass it on to them. However, this isn’t a usual sexually transmitted disease. Instead, it’s a monster that follows you, forever, at walking pace, until it kills you. Wherever you are in the world, it will be walking towards you. Eventually, it will get you. The only way to avoid it is to give it over to someone else. Oh, but if they die, it passes back to the last person who had it. The concept of this film feels like something from a film studies class but, honestly, it’s incredible. But even better if you’re high. 4. Get Out (2017)This film, written and directed by the incredible newcomer Jordan Peele, won the Oscar for best original screenplay. If that isn’t enough of a reason to watch this psychological thriller then I don’t know what is. The film is funny, scary, horrifying and has so many levels to it, it’s hard to unpick it in one sitting. In fact, if you have the entire day free, it might be worth watching Get Out a few times this Halloween. ![]() On the surface, the movie follows a young black American as he anxiously visits his white girlfriend’s parents. Other than some mild racist views, the visit seems to be going well. However, the plot then unravels, everything turns on its head and, before you know it, you’re watching perhaps the craziest film you’ve ever watched. If you haven’t seen this movie yet, then I might have to suggest you put it above the rest on your priority list this Halloween. It’s unreal. 5. Midsommar (2019)Florence Pugh’s powerhouse performance in this twisted, confusing and horrifically psychological film is enough of a reason to watch this. Similar to others on this list, this is simply a very well acclaimed modern horror. It isn’t easy to understand, and may leave many scratching their heads, but it leaves you with a feeling of both beauty and disgust – like watching a colorful butterfly slowly take apart and devour an ant. If you’ve seen the Wicker Man, then the aesthetic is similar. If not, then here’s some information. The movie is set in a cult in Sweden and follows a young woman as she slowly emancipates herself from a toxic relationship – at least, that’s what some believe. You may not even see an ounce of this from the film; that’s why it’s so wonderfully confusing. Cannabis may be the perfect substance to unlock the true meaning of this movie. 6. The Conjuring (2013)The Conjuring, although written in 2013, is a far more traditional horror film. If you like the paranormal, demons and possession – then there aren’t many better than this. Ed and Lorraine Warren, both acclaimed demonologists, are hired to help the Perron family who have recently moved into a haunted farmhouse. What’s amazing about this film is you are left wondering: did this actually happen? The movie has all the classic tropes, yet still feels original. In fact, this could be one of the most genuinely scary films on the list so I wouldn’t recommend watching it alone. Watching it with cannabis will make this rollercoaster even more thrilling. Final ThoughtsHalloween is a time for a spook and these films will certainly help you to get there. Not only does this list have variety, but they all have a genuine quality about them. None of these films, in my opinion, are ‘cheap’. They are all, rightfully and deservedly, on the list. But considering we’re in a sort-of psychedelic renaissance with both policy and public opinion shifting in favor of these compounds, it’s not very off-base to assume that some of them will be more widely accessible one day. What might be next on the list? Let’s take a look. Possible timeline for cannabis legalizationIt’s only a matter of time before cannabis is fully legalized, although sometimes it can still be difficult to picture… especially for those of us stuck living in very restrictive prohibition states (I’m looking at you, Midwest and Deep South). But exactly how long is that timeline? Some believe it could happen as early as the end of this year. As much as I would love to see that happen, I’m not sure it will be quite that soon. However, for a few different reasons, I do think we could see weed completely legalized sometime in 2023, or by early 2024 at the latest. First, we have midterm elections coming up and all 435 seats in the House of Representatives (as well as 35 of the 100 Senate seats) will be contested, and federal cannabis legalization depends largely on who controls congress. It does seem that republicans currently have the edge, especially as voters continue to worry about inflation other economic issues, but that may not matter as we have been seeing a growing number of pro-cannabis republicans, both in office and constituents. Next, we have a handful of states that plan on putting recreational cannabis up for a vote in November. Should they all pass – and it’s likely they will – that will put us over the tipping point with more than half of our states having passed adult-use marijuana laws. It doesn’t sound like much… only a few more states with legal pot, what’s the big deal right? Well, it has many implications for the government so it’s actually a huge deal. If more than half the states in our country are openly defying federal law (and many more are towing the line with medical pot), that makes our government look very weak. The last thing a government wants is to look like it has no control over its people. Another thing the government is not too keen on is looking hypocritical. Despite being hypocritical nearly all the time, the more obvious that is to voters, the less trust people have in their government, and the more likely they are to rebel against it. On October 6th, President Biden issued a sweeping, unconditional pardon for anyone who has been convicted of simple cannabis possession under federal law. While this is amazing and long overdue news, it does set a very confusing legal precedent. From this point forward, how can people continue to be arrested and charged with cannabis-related crimes that everyone else got pardoned for? It’s hypocrisy to the max, and the only possible thing this could lead to is the government eventually being buried in lawsuits. All that said, it’s safe to say that pot will likely be legal soon. How soon exactly is up for debate, but once again, I imagine that within a year, we’ll see the changes we’ve been fighting for. And once cannabis is no longer prohibited, it will be time to push these decriminalization and legalization efforts on to new substances. Effective dose vs lethal dose ratiosWhen looking up how drug prohibition works and what some of the parameters are for legalizing various compounds, a concept that came up frequently was “effective dose vs lethal dose”. This is referring to the dose it takes to get high versus the dose it takes for the drug to kill someone, and how that ratio compares to other drugs. ![]() For example, the lethal dose to die on alcohol is only 10 times the dose needed to get drunk. Compare this with psilocybin, which has a lethal dose that is estimated to be 1,000 times higher than the effective dose, or even ketamine whose lethal dose is 38 times higher than the effective; one can easily ascertain that psychedelics – both natural and synthetic – are relatively safe. Follow the moneyAlthough our overlords would like to have us think that they are keeping certain substances illegal for reasons like the one I listed above, the reality is, it’s mostly related to money. The government receives a substantial amount of money from several industries that benefit from the prohibition of cannabis and psychedelics. These include oil, biotech, and pharmaceutical companies, big tobacco, the for-profit prison industry, and so on. All these industries are funneling hundreds of millions (possibly billions) of dollars to government representatives and lawmakers through political donations, lobbying, and various other types of corporate interest payments. Knowing this makes it easy to conclude that many of the laws we have in place are there to serve the best interests of the corporations that pay our government, rather than the citizens they were elected to represent. Taking that into consideration, what can we expect as far as future drug legalization? Honestly, it’s hard to say. On one hand, we’re already seeing policy changes on a smaller scale with a growing number of cities across the country that have decriminalized different psychedelic drugs. Look at Ann Arbor, Michigan, whose city council voted unanimously to decriminalize all entheogenic plants back in September 2020. That includes ayahuasca, psilocybin mushrooms and truffles, mescaline-containing plants (excluding peyote), ibogaine, and other plants with hallucinogenic properties that are still considered illegal under state and federal law. Ann Arbor is probably the most progressive example, but many other cities have decriminalized at least one psychedelic compound, psilocybin being the most common. Based on that information, it’s safe to assume that recreational psychedelics legalization will follow the same path as cannabis reform. On the other hand, it does seem unlikely that many of these drugs will be legalized for widespread adult-use… why would the government want to give us that much power over our own happiness and well-being? Yes, cannabis will be totally legal soon, but that took decades of rebellion and we’re still not quite there yet. What’s more plausible is that the government will try to legalize the majority of psychedelic compounds for pharmaceutical use only, since big pharma spends the most on political lobbying and it’s easier to get medical legalization bills passed anyway. It’s likely that drugs such as MDMA, ketamine, and LSD will be used largely in therapeutic settings, whereas we may see more of a push at the grassroots level to decriminalize/legalize plant-based entheogens for all, since it’s harder to regulate or ban something that grows from Earth. Public opinion on psychedelicsWith so many policy changes happening on the psychedelics front, it seems pretty obvious that the general public is opening up to the idea of using them, at the very least, in therapeutic settings. In a recent poll by internet-based analytics company, YouGov, it was determined that roughly 28% of Americans have tried one or more psychedelic drugs (of the seven polled) at some point in their lives. ![]() The largest number of people reported having tried LSD (14%), followed closely by psilocybin (13%). Next, nearly one in ten claimed to have used MDMA (9%) and mescaline (8%). A smaller but still significant number say they have used ketamine (6%), DMT (6%), and/or salvia (5%). Interestingly enough, the study found that support for legalizing psychedelic drugs still remains low, despite how many people claim to have tried them. This is especially true among people 65 or older, religious individuals, and those living in rural areas. The people most likely to support psychedelic drug reform were those who have tried them before (naturally), people with postgraduate degrees, 30- to 44-year-olds, and people living in the western United States. Overall, 54% of Americans do support allowing more research into psychedelic substances, particularly to use for military members and veterans suffering from PTSD – doubling down on the earlier sentiment that it’s often easier to legalize drugs in a medicinal context. What’s on the horizon for legal drugs?Psilocybin: A lot is going on with psilocybin at the state-level, which leads me to believe that it will be one of the first drugs to possibly be decriminalized or legalized following cannabis. For example, this November, Coloradoans will vote on the Natural Medicine Health Act (NMHA or Initiative 58), which would legalize psilocybin (as well as a handful of other entheogens) for use in approved healing centers. Additionally, the safety profile of mushrooms is much better than most other drugs, both psychedelic and otherwise. A recent study published in the Journal of Psychopharmacology found that only 0.2% of shroomers (or 19 out of 9,233) end up in emergency rooms after use, and these adverse incidents are almost exclusively psychological in nature, meaning they resolve themselves once the high wears off a bit. Ketamine: Standard Ketamine has only received approval for use as an anesthetic, but there is a huge market for off-label use. Also, a different form of ketamine called esketamine (S-ketamine) has been legalized to use in the treatment of depression. Another type of ketamine called arketamine (R-ketamine) is currently undergoing research and will likely be approved for therapeutic use in the very near future as well. For reference, S-ketamine and R-ketamine are two halves of a whole – the whole compound being standard (or racemic) Ketamine. Individually, these compounds have similar effects and benefits as racemic Ketamine. MDMA: Again, we’re looking at Colorado as a glimpse into the future of drug legalization, this time with MDMA. The most recent news to come out of the state is the passage of HB 1344, which essentially legalized the use and possession of MDMA by prescription only. It won’t go into effect until the federal government also legalizes it, but once that happens, Colorado has already laid the groundwork for a functioning medical MDMA program. ![]() This is only one state, but more will follow suit. And the more states we have doing this, the more pressure it puts on the government to legalize pharmaceutical MDMA. Additionally, MDMA has proven to be quite effective at treating PTSD. The VA (Department of Veteran’s Affairs) launched clinical trials earlier this year to test its efficacy and safety, compared to the standard available treatments. Final thoughtsIt’s hard to say exactly how soon any of this will happen; but we do know that eventually, it will. It’s inevitable. Not only are more and more studies coming out to back up the use of psychedelics in therapy, but the industry is growing before our eyes. Some of these companies are already publicly traded. If anything, this indicates that psychedelics are heading down the same path as cannabis, but at an even faster rate. Please enjoy your chosen products responsibly! Germany’s decision to legalize cannabisGermany isn’t the first EU country to decide on cannabis legalization for recreational use. Malta did it first in December of 2021, implementing a system whereby users can grow cannabis and use it, but without a sales market. Luxembourg also announced plans to set up something in the future, with a generally similar model of allowing cultivation without a sales market; but as of yet, no law passed. Really, though, if looking at the whole of Europe, the first legalization actually belongs to Georgia of all countries. Georgia passed a legalization by way of its constitutional court in 2018. Much like Malta, it doesn’t include a sales market, or even legal cultivation; making for a pretty strange legalization that only allows possession and use, with no legal way to obtain it. Then Switzerland upped the ante, when its office of Social Security and Health Commission announced in September, 2021, that cannabis shouldn’t be a prohibited drug anymore. Nothing more was stated at the time about what a corresponding market might look like, but one is expected to open. Switzerland was the first country in the EU, and Europe as a whole, to make this decision. We don’t know when to expect the official bill or full market, though. ![]() Enter Germany. In April of this year, an announcement was made in Germany via Marco Buschmann, the Justice Minister, that stated he and the Ministry of Health were discussing and figuring out a cannabis legalization measure. Currently Germany is the home of the biggest cannabis market in the EU, though its all medical. The current process which would greatly expand this market, involves talks between different government offices, with an expected bill later this year. This announcement was accompanied by another announcement on the same day by Christian Lindner, the finance manager. He said that Germany was indeed in the process of figuring out some kind of legalization, and that cannabis would be legal soon enough. These announcements weren’t the start of it though. Germany held elections last year which greatly changed the political landscape, affecting the ability for recreational marijuana. Especially since long-standing Chancellor Angela Merkel, who is opposed to legalization, did not run for re-election. The resulting ruling coalition is now made up of the Social Democrats (SPD), Green Party, and Free Democrats (FDP), all of which are pro-cannabis legalization parties. This is worlds away from Merkel’s previous government which was right-winged and generally against cannabis reform. In November 2021 it was already said by the new leadership that a bill was in progress. Germany and a new recreational marijuana planAs of right now, only key points were released on the new Germany recreational marijuana reform measures. According to Politico, these reforms were made available Wednesday the 19th of October to the RND newspaper group, Germany’s editorial network. The document contains the following provisions, though none of this is in final form, or approved. First off, the new law would mean cannabis wouldn’t be classified as a narcotic drug anymore. In terms of regulations, it sets the age for use at 18, and would allow users to purchase and possess up to 20 grams of cannabis. Technically, it wouldn’t matter where the cannabis came from, or the amount of THC in it, so long as it doesn’t cross the limit of 15%, which would be the cap for legal purchases and growing. The reforms also call for the allowance of two home-cultivated plants. ![]() Then it goes on to make a strange designation, saying that those between the ages of 18-21, can only access products with up to 10% THC maximum, apparently to ward off brain damage. Its hard to say where this idea of possible brain damage comes from, or how much its believed to be a real issue, especially given the context of it coming up as part of a broad legalization measure. Regardless, that’s a part of the current draft key points. Apparently, those under 18 caught with cannabis, wouldn’t be subject to any formal punishment. However, youth welfare offices would be able to force these young users into prevention courses. And, of course, whatever an under-ager has on them, would be confiscated. The draft rules speak of regulation for dispensaries, and minimum distances between such businesses and schools or other youth facilities. Selling cannabis would predictably require a license, with unlicensed sales considered criminal activity. Strangely, (or not), it dictates that synthetic cannabinoids would be illegal, but like most countries, chooses not to explain how this wouldn’t rule out its cannabis pharmaceutical market, which offers synthetics like dronabinol and nabilone. Any advertising of cannabis products would be banned. It states, “Recreational cannabis is sold in outer packaging (plain packaging) with no promotional design,” and that there can be no “advertising purchase suggestions” in stores or online. Sales might be expanded past dispensaries, and might also be allowable in pharmacies. The pharmacy idea is under examination, as well as online purchasing, both of which are thought to be useful for limiting the black market. According to the document: “On the other hand, the suppression of the black market would probably be greater if recreational cannabis could also be purchased online, which is convenient and increasingly important.” It goes on to say that the idea of specialty shops with options for consumption, are also under investigation. More details…like taxes and pricingAll cannabis products would have a sales tax, as well as a likely cannabis tax. Nothing more specific about the amount was stated, other than that is should be assessed based on the amount of THC in a product. It does make a good stipulation, in that it says the total price including taxes, should be very close to the black market price. ![]() The document also touches on where the cannabis in the industry must come from. Right now, Germany is both a large producer and a large exporter for medical cannabis products. Since global laws are not as up-to-date, a recreational market couldn’t allow imports, leading to a requirement for Germany to grow all the cannabis for this market. The document says: “According to a preliminary assessment, international trade in cannabis for recreational purposes is not possible on the basis of or in accordance with international framework conditions.” And that “According to this preliminary assessment, national demand would have to be covered by German production.” It was requested that the Federal Ministry of Health confirm this document of key points, which it did not do. The Ministry pointed to the federal government still debating and voting, meaning this report is still quite likely to undergo revisions.
